Appellant-father alleges that the district court abused its discretion when it declined to hold an evidentiary hearing before denying his motion to modify custody. He argues that the court erred when it refused to give sufficient weight to the initial affidavits of respondent-mothers parents, which favored appellant-father, but were later contradicted by subsequent affidavits from respondent-mothers parents. Because of the seriousness of the allegations and the contradictory nature of the affidavits by the same affiants, we reverse and remand for an evidentiary hearing.
